YourMTB.com Terms of Use

By using YourMTB.com (a.k.a., YourMountainbiking.com), you agree to the following terms of service. The rules and standards explained on this page (which we've tried to make as clear and simple as possible) protect the rights of this website's users as well as the company that operates this website, its managers, owners and shareholders.

1. YourMTB.com is a free service made available to anyone interested in the sport of mountain biking. It is operated by and is the property of Enthusiast Group LLC, which may determine and establish rules governing this website and how it may be used -- and change them at any time.

2. YourMTB.com accepts and welcomes content -- articles, essays, photographs, videos, etc. -- from its users. This site is intended to be by, for, and about mountain bikers and mountain biking, so please only submit articles, photos, and videos of mountain biking-related subjects and events. "Off-topic" submissions may be removed by YourMTB.com.

3. Anything that you post on YourMTB.com is your responsibility. If you post something that's harmful to others or gets you sued, you alone bear responsibility for defending yourself.

4. You acknowledge and agree to the YourMTB.com Privacy Policy.

5. The subject and content of the material submitted to YourMTB.com should be appropriate for viewing by all ages. Indecent or offensive language may be rejected or edited.

6. YourMTB.com does not pre-screen most content before it is published on the website. However, we have sole discretion to remove from the site user-submitted content that violates these terms of service. We may do this when one of our employees notices content that violates our rules, or when another website user has alerted us to content that may violate our rules. In the latter case, one of our employees will investigate complaints to determine if the complaint is valid, and act accordingly in removing the content, editing it, or leaving it intact.

7. YourMTB.com may screen still photographs and video content submitted by users. This is primarily a means to prevent inappropriate visual material, such as pornography, from being being visible to users. Photographic or video images that are published on the site and that other users believe to be inappropriate will be investigated further to determine if the complaints are valid, and YourMTB.com employees will act accordingly in removing the content or leaving it intact.

8. You agree not to post content that is illegal, threatening, abusive or defamatory to others, pornographic, obscene, inaccurate, misleading, or otherwise objectionable.

9. You agree not to post on YourMTB.com content (text, photos, or video) that rightfully belongs to another and claim it as your own. This is a violation of copyright law and can get you in serious trouble. You will be completely responsible for any damages resulting from your willful violation of another's copyright. YourMTB.com has no responsibility other than in removing material from the website when we have been notified of a copyright violation.

10. All of the content posted on YourMTB.com is protected by our copyrights and copyrights of the users who posted the content. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display or in any way exploit any of the content on YourMTB.com in whole or in part.

11. In using this website, you understand that you may be exposed to material that has not been reviewed by us, and may be offensive, inaccurate, misleading, or otherwise objectionable. These terms are defined at the discretion of YourMTB.com.

12. YourMTB.com and its employees and owners cannot be responsible for the contents of any site that is linked to content published on YourMTB.com.

13. You agree not to send unsolicited commercial e-mail ("spam") to addresses on YourMTB.com or through our servers. You agree not to post advertising or commercial messages on YourMTB.com except in those areas of the website designed for commercial messages. The definition of advertising and commercial messages is at our discretion.

14. YourMTB.com may set limits on what you can do within our service, and how much you can use any feature of the site. We have sole discretion to deactivate your account, block your address, and otherwise keep you from using YourMTB.com and its services.

15. YourMTB.com does not take any responsibility for information that is lost or deleted from our system, regardless of who may be at fault.

16. You agree to accept all responsibility for your dealings and interactions with other users, and not to hold YourMTB.com responsible for the conduct of people you meet through the site.

17. You agree to give YourMTB.com the right to publish and reproduce on the website, in e-mail newsletters, RSS feeds, and other digital-delivery means any content that you submit, with no expectation of monetary or other compensation.

18. You agree to permit YourMTB.com to use your content in any form external to the website, e-mail, RSS, etc. in exchange for a share of the profits from such use. This includes such uses as user submissions being included in or on calendars, DVDs, books, posters, t-shirts, coffee mugs, etc. YourMTB.com will send you a share of profits from sales on such retail products that include your content. By submitting content to YourMTB.com, you agree to participate in this profit-sharing program.

19. Please report any violations of the Terms of Service to YourMTB.com, either by sending e-mail to abuse@yourmtb.com, or by flagging inappropriate content with the tools that accompany each piece of content on the website. Our failure to act on a particular breach does not waive our right to act on subsequent or similar breaches of our rules.

20. YourMTB.com reserves the right to change any or all provisions of this Terms of Service at any time.


General Guidelines for User Behavior

1. Language and content that you post to YourMTB.com should be appropriate for all ages.

2. Please treat everyone with respect, and keep conversation on the site polite.

3. Respect others' opinions.

4. Understand that the content submitted by YourMTB.com users has not been vetted in the way that traditional works of journalism are. In other words, take what you read from other users with a grain of salt.

5. Remember that people who use YourMTB.com are on the site because they want to read about mountain biking. Respect the mission of the site and don't use it for other topics.

6. Please post your content in the most appropriate category, and don't post duplicate content in multiple places.

7. Only post content that is your own. Misrepresenting others' articles and images as your own can have serious and expensive consequences for you. Don't do it!

8. Don't spam the website's users. YourMTB.com provides specific areas for commercial messages related to mountain biking. Don't put commercial messages in inappropriate areas, and don't use this service to send such messages to other website users.

9. Be careful about posting your personal information on YourMTB.com. Share what you want about yourself, but understand that it can be seen by many people around the world. Respect the privacy of others by not posting their personal information on the site without their permission.


Intellectual Property Rights

1. The content on YourMTB.com, except all User Submissions, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to YourMTB.com and Enthusiast Group LLC, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions.

2. Content on YourMTB.com is provided AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.

3. You agree to not engage in the use, copying or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of User Submissions of third parties obtained through the website for any commercial purposes.

4. If you download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein.

5. It is the policy of YourMTB.com, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who may infringe copyrights or other intellectual property rights of others. In other words, if we observe or learn that content posted on YourMTB.com actually belongs to someone else but is being credited on this website as being that of a YourMTB.com user, we will shut down the user's account and remove the content.

6. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please notify publisher@yourmtb.com so that we may investigate. Include the following information:

  1. A description of the copyrighted work that you claim has been infringed;
  2. A description of where the work is located on YourMTB.com (Web address or URL);
  3. Proof that the infringed work belongs to you;
  4. Your address, telephone number and e-mail address;
  5. A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent or the law; and that the information provided is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
